Terms of service

These terms are an agreement between you and Badhani Technologies (8A, Baghani, Kotabagh, Nainital, Uttarakhand, India) for the use of the Newspaper Maker (newspapermaker.in) website and software. By creating an account or using the service, you agree to these terms.

The service

Newspaper Maker is online software for designing pages of Hindi newspapers and magazines and exporting them as PDF. It is provided on a subscription basis.

Your account

• You must be at least 18 years old and give accurate information to create an account.
• Keeping your password and login safe is your responsibility. You are responsible for all activity on your account.
• Only one login can be active at a time on the Basic and Daily plans. An account may not be shared with more people or newspapers than its plan allows.

Plans, issues and payment

• Plan prices and limits (issues per month, pages per issue and newspaper titles) are shown on the website. Prices are in Indian rupees; GST is extra as applicable.
• An issue is one dated edition of one newspaper title. It is counted when its final PDF is downloaded for the first time. Corrections within 15 minutes of that download are free, and re-downloading the same issue is always free; after 15 minutes the issue is locked, and changed content counts as a new issue.
• Extra issues (₹50 each) and extra pages beyond the plan limit (₹15 each) are charged from your prepaid balance.
• Payment is taken in advance through a payment gateway. Plans are prepaid for one month or one year and do not renew automatically; you renew by paying again.
• Price changes will be announced at least 15 days in advance and apply from the next billing period.
• Refunds follow our refund and cancellation policy.

Fair use on unlimited plans

“Unlimited” on the Pro plan covers the normal publishing needs of a newspaper group. Reselling the service, or use far beyond a normal publishing schedule, may require a custom plan; we will contact you before making any change.

Your content and responsibility

• The stories, photos, logos and ads you add are your content, and you keep the copyright.
• The publisher is fully responsible for the accuracy and legality of published content (including press registration law, copyright and defamation) and for any permissions needed.
• We store and process your content only to provide the service.

Acceptable use

You will not use the service for:

• Content that is illegal, misleading, obscene, hateful or that infringes anyone’s rights.
• Copying, reverse engineering or reselling the software, or trying to harm the service.
• Putting unusual load on our servers or trying to access other people’s accounts.

Intellectual property

The Newspaper Maker software, design, templates, name and logo are the property of Badhani Technologies. A subscription gives you a limited, non-transferable right to use the service. Fonts are provided under their own open-source licences.

Availability

We do our best to keep the service running at all times, but maintenance, updates or causes outside our control may sometimes interrupt it. Download the PDFs of important pages in good time.

Limitation of liability

The service is provided “as is”. Our total liability in any case will not exceed the amount you paid us in the previous 3 months. We are not liable for indirect losses such as publishing delays or loss of business.

Closing an account

You may close your account at any time. For serious breaches of these terms, we may suspend or close an account after notice, giving reasonable time to download your PDFs and content first.

Governing law and jurisdiction

These terms are governed by the laws of India. The courts of Nainital, Uttarakhand, have exclusive jurisdiction over any dispute. Before going to court, we will try to resolve the matter through discussion.

Changes to these terms

We may update these terms. Significant changes will be announced by email or on the website. Continuing to use the service after a change means you accept the new terms.
